What the 2026 NAR Code of Ethics Updates Mean for Your Real Estate Practice

As of January 1, 2026, the National Association of REALTORS® (NAR) rolled out important changes to the Code of Ethics and Standards of Practice that all licensed agents should understand. These updates are designed to make ethical standards clearer, easier to enforce, and more aligned with how REALTORS® work today.

Clearer Rules Around Compensation and Disclosure

One of the biggest updates involves Article 7. The new language now clarifies that if a REALTOR® receives compensation from more than one party in a transaction, that disclosure and approval must only be given to your client or clients — not to every party in the deal. This change reflects how many buyer and seller compensation arrangements work after the 2024 settlement agreements and helps protect confidentiality while keeping clients informed.

The Code also deletes Standard of Practice 3-4, which previously required disclosure of variable rate commissions. Because MLS compensation practices have evolved, this standard is no longer necessary.

Fair Housing and Professional Conduct Updates

Another key change affects Article 10 and Standard of Practice 10-5, which addresses discrimination and harassment. NAR has updated the language to define “harassment” more clearly and focus the standard on conduct that occurs in a REALTOR®’s professional capacity and real estate related activities.

NAR President Kevin Sears explained the change this way:

“Consistent with our deep commitment to upholding principles of fair housing and equal treatment for all consumers, these amendments provide clarity to our members, reduce risk for state and local associations enforcing the Code of Ethics, and bring Article 10 in line with similar requirements applied by other large trade associations.”

This makes it easier for local associations to enforce the Ethics Code fairly and consistently.

  • Client agreements stay private. You no longer need to share details of buyer-broker compensation with sellers or their brokers unless your client requests it.

  • Clearer standards reduce confusion. When handling sensitive conversations about conduct, the updated definition of harassment helps you know what is — and is not — acceptable in your work.

  • Better risk management for local boards. Associations can enforce the Code with consistency, protecting both members and consumers.
